What are the steps?

Step 1: Learn about the EB-3 Green Card

Check to see if you meet the eligibility requirements for the EB-3 Green Card.

Step 2: Apply for one of our current EB-3 job openings

Our EB-3 Job openings change often and fill up quickly.

Step 3: PERM Labor Certification – Typically requires 9-14 months

In this step the prevailing wage request is filed, the local recruitment is conducted and the ETA 9089 PERM petition is filed.

Step 4: I-140 petition for immigrant worker – 1 month (premium processing) – 6-9 months for regular

We recommend premium processing. it depends on your visa status.

Step 5: Adjustment of Status or Consular Processing – 8-13 months

This is the last immigration step. We apply for Adjustment of Status to Permanent Residence with USCIS or Consular Processing.

Step 6: Start work at your new job!

Once your green card is approved you can come to the U.S. to start working for your sponsor employer.

    1. What is the advantage of the EB-3 program over other US immigration programs?

    The EB3 program does not require any work experience, language test or net worth value. Through this program, you will arrive in the US with a permanent, full-time job and permanent residency for you and your family. You will also be able to include your spouse and unmarried children below the age of 21 in your application. They will then be able to work and study in the US as Green Card holders. It also takes around 2.5 to 4.5 years to process, which is a shorter period compared to most immigration programs.

    EB3 visas are for unskilled job positions. The education and job requirements are minimal. As such, the positions fill up quickly. It is a first come, first serve basis.

    Under this program, a joint application is filed between the employer and employee with the Department of Labor. In the event the employee fails to fulfill the job duties (i.e. suddenly leave the job) there is a possibility that the employer can file a complaint with the Department of Labor which may result in the termination of his/her Green Card. It is recommended that you stay with the employer for at least 1.5 year to avoid any issues such as this.

    All employers must submit a prevailing wage determination with the Department of Labor which ensures that they are paying at least the minimum wage set in their state. Salaries vary depending on the job and the area but they usually average around USD 10.00 – USD 18.00 per hour.

    All legal paperwork will be handled by licensed immigration attorneys.

    1. Initial Assessment

    2. Employer Selection
      After a complete review of your work experience and skills, LVEB will forward your files to our network of employers. They will review your background and if selected, make a job offer. LVEB will speak to you about the job offer and its terms. If you accept the job, the employers will then reach out to their immigration attorneys to prepare for the Department of Labor and USCIS filings.
    3. File Preparation
      The team of immigration attorneys will prepare your document, submit and follow-up your application. This includes: helping you gather proper documents so you qualify under the selection criteria applicable to your category; assisting you in completing your application to maximize your chances of success, and ensuring you submit the appropriate required documents,

    The Green Card can only be processed upon arrival in the U.S. In the meantime, the visa is endorsed and serves as a Permanent Residency document until the actual card arrives. This can be used for employment, opening bank accounts, etc.
